Terms and conditions webshop

1. General determinations

1.1. The e-commerce website of Humida, a bv with registered office at Heppensesteenweg 57, 3945 Ham, Belgium, VAT BE0649.837.543, RPR Hasselt (hereafter “Humida”) offers her customers the possibility to purchase the products online out of her webshop.
1.2. The present terms and conditions webshop are applicable on every order which is placed by a visitor of this e-commerce website (“customer”). By placing an order through the webshop of Humida the customer explicitly has to accept these conditions, by which he agrees with the applicability of these terms and conditions, with exclusion of all other terms.
1.3. Additional terms and conditions of the customer will be excluded, except when these are accepted in writing and explicitly by Humida.

2. Price

2.1. All mentioned prices are expressed in EURO, always inclusive VAT unless otherwise mentioned and all other obligated taxes for the customer.
2.2. Deliver costs are mentioned separately.
2.3. The price quotation exclusively refer to the articles like described. The accompanying photographs are decoratively and can contain elements that are not included in the price.

3. Offer

3.1. Despite the fact that the e-commerce website is put together with the greatest care, it is possible that the offered information is incomplete, contains material faults or is not up to date. Apparent mistakes or faults in the offer do not bind Humida. Humida is only held to a commitment of means, regarding correctness and completeness of the offered information. Humida is in no case liable in case of material faults, setting or print errors.
3.2. When a customer has specific questions about e.g. measurements, availability, delivery time or delivery manner, we ask the customer to contact our customer service beforehand.
3.3. The offer remains as long as the stock lasts an can be altered at all times or revoked by Humida. Humida cannot be liable for the unavailability or being sold out of an edition or a product. If the offer is of limited time or occurs under conditions, this is explicitly mentioned in the offer.

4. Purchasing online

4.1. The customer has the possibility to purchase articles out of the range of Humida online.
4.2. To purchase a product, the customer adds the product to his shopping cart. Then the customer fills in his contact data and invoice data. At the bottom the customer get an overview of his order and the payment method.
4.3 The customer has the choice between these payment methods:

4.4. Humida is entitled to refuse orders due to a serious shortcoming of the customer regarding to orders that customer is involved.

5. Delivery

5.1. When we receive payment, the order is shipped. The delivery term is 2 or 3 days after receiving payment, under normal circumstances, except for holidays, strikes and such. The delivery costs are mentioned by the order.
5.2. Articles ordered through our webshop are delivered in Belgium and the Netherlands. If a customer wants to order from a different country, the customer has to contact customer service.
5.3. The delivery happens by mail or courier.
5.4. The order will be shipped to the address chosen by the customer.
5.5. Every visible damage and/or quality shortcoming of an article or another shortcoming by delivery, has to be mentioned at Humida by the customer immediately.
5.6. The risk of loss or damage passes to the customer from the moment he (or a designated third party, who isn’t the carrier) has the goods physically in his possession.

6. Reservation of ownership

6.1. The delivered articles stay until the complete payment by the customer, the exclusive property of Humida.
6.2. The customer commits to prove if necessary third on the reservation of ownership of Humida, e.g. to everyone who would seize the not fully payed articles.

7. Warranty

7.1. According to the law of 21 September 2004 concerning the protection of consumers by sale of consumption goods has the consumer lawful rights. These lawful warranty is applied from the date of delivery to the first owner. Every commercial warranty leaves this right unabated.
7.2. To invoke the warranty, a customer has to submit a proof of payment.
7.3. For articles which were purchased online and are delivered to the customer at home, the customer has to contact the customer service of Humida and has to return the article at his expense to Humida.
7.4. When determinating a deficiency the customer has to inform Humida as soon as possible. In every case every deficiency has to be reported by the customer within 14 days after receiving the goods. After this every right of repair or replacement expires.
7.5. The (commercial and/or lawful) warranty is never applicable to defect originated by accidents, negligence, a fall, use of the article contradictory to the purpose of which it is designed, not following the instructions or manual, adjustment or changed to the article, heavy-handed use, bad maintenance, or any other abnormal or incorrect use.
7.6. Defects which manifest after a period of 1 month following the date of purchase, or delivery, are deemed to have no hidden deficiencies, except counterproof of the customer.

9. Sanctions for non-payment

9.1. Unabated the execution of other right over which Humida possesses, is the customer in case of non- or late payment from the date of the default by operation of law and without notice owed an interest of 10% per year on the not payed amount. In addition is the customer by operation of law and without notice owed a flat-rate compensation of 10% on the involved amount, with a minimum of 25 Euro per invoice.
9.2. Unabated the previous Humida hold itself to the right to not take back (complete) payed articles.

10. Privacy

10.1. The responsible for the processing, Humida respects the European GDPR law regarding the protection of the personal life in processing personal data.
10.2. The by you shared personal data will only be used for the following purposes: the execution of the agreement, the processing of the order, sending newsletters, advertising or marketing purposes.
10.3. You have the lawful right to inspection and potential correction of your personal data. With proof of identity (copy identity card) you can get a written statement of your personal data through a written, dated and signed application to Humida, Heppensesteenweg 57, 3945 Ham, Belgium or info@humida.be. If necessary you can request to correct data which is incorrect, incomplete or not pertinent.
10.4. You can resist yourself costless to the use of you data for direct marketing. You can direct yourself to Humida, Heppensesteenweg 57, 3945 Ham, Belgium or info@humida.be.
10.5. We treat your data as confidential information and will not pass it along, rent or sell it to third parties.
10.6. The customer is responsible for keeping his login data and use of his password confidential. Your password will be stored encrypted, Humida has no access to your password.

11. Use of Cookies

11.1. During a visit to the website ‘cookies’ can be placed on the hard drive of your computer. Cookies cannot be used to identify people, a cookie can only identify a machine.

12. Violation on validity – non-renunciation

12.1. If a determination of these Terms and Conditions is invalid, unlawful or declared void, this will in no case affect the validity, lawfulness and the applicability of other determinations.
12.2. Negligence at any given moment by Humida to force one of the in these Terms and Conditions listed rights, or execution any of these rights, will be seen as a renunciation of such determination and will never affect the validation of these rights.

13. Proof

13.1. The customer accepts that electronic communications and back-ups can be used as evidence.

14. Applicable law – disputes

14.1. The Belgian right is applicable, with exception of the determinations of the international private law on applicable law.
14.2. The Belgian right is applicable. Only the courts of the judicial district of Hasselt is competent. The consumer can turn to the ODR platform (http://ec.europa.eu/consumers/odr).
